Individuals and businesses often need to use official documents in foreign countries for the purpose of studying abroad, getting married internationally, conducting business overseas, or handling legal matters in another country. This is where an apostille comes into play.
An apostille is a form of authentication issued for official and notarized documents to be recognized in countries that are part of the Hague Apostille Convention (Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents). It serves as a certification that verifies the authenticity of the document and the authority of the issuing official.
As of January 11, 2024, Canada officially joined the Hague Apostille Convention, simplifying the authentication process for documents used in member countries.
Official Documents Services (ODS) handles the apostille process for documents issued in Ontario or federally, such as birth certificates, marriage certificates, Canadian passport copies, and documents notarized in Ontario.
The apostille process ensures that your documents are legally recognized in another country. Here’s a step-by-step breakdown:
Determine If Your Document Needs an Apostille
Apostilles are only required for documents used in a country that is a member of the Hague Apostille Convention. If the country is not a member, you may need additional authentication or consular legalization. The lists of countries that accept apostille or require consular legalization can be found here [link to blog post 2].
If in doubt, reach out and we will advise whether your document can be apostilled.
Verify Document Eligibility
Certain documents must be original or notarized copies before they can be apostilled. Confirm that your document is eligible for authentication.
Notarization (if required)
This step applies mainly to documents not issued by a public body, such as affidavits and powers of attorney, as well as certified copies of the documents.
Submission to ODS
Submit a service request to Official Document Services in Ontario in person or by regular mail.
Commonly apostilled documents include:
Personal Documents:
– Birth Certificates
– Marriage Certificates
– Death Certificates
– Power of Attorney
– Criminal Background Checks
Business & Corporate Documents:
– Certificates of Incorporation
– Business Licenses
– Corporate Resolutions
– Articles of Organization
– Patent and Trademark Registrations
Educational Documents:
– Diplomas and Degrees
– Transcripts
Some documents cannot be apostilled even if they are notarized. Examples of documents that cannot be apostilled include:
documents commissioned by a Commissioner for Taking Affidavits
foreign-issued documents (all documents issued outside of Canada)
religious documents (baptismal certificate, etc.)
legalized documents (previously authenticated documents already legalized by a consulate or embassy)
pseudo-legal documents (legal-sounding documents stating false rules that claim to be law).
